Eligibility and Acceptance

You must be at least 18 years old and able to form a binding contract to use this Site. By using the Site, you represent that you meet these requirements and that any information you submit is accurate and complete.

We may revise these Terms at any time. The "Last Updated" date above reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

Permitted Use of the Site

You may use the Site for lawful purposes related to learning about, requesting, or managing our Services. You agree not to:

• Use the Site in any way that violates applicable law or regulation
• Submit false, misleading, or fraudulent information, including in an estimate or quote request
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems
• Introduce malware, scrape content by automated means, or interfere with the Site's operation
• Copy, reproduce, or republish Site content for commercial purposes without our written permission

Estimates, Quotes, and Service Agreements

Information on the Site, including any pricing ranges, project galleries, or service descriptions, is provided for general informational purposes and does not constitute a binding offer or a guaranteed price.

Submitting a contact form, quote request, or inspection request does not create a contract between you and FCV Restoration & Construction, and does not obligate either party to proceed. Any estimate we provide is an estimate only, and is subject to on-site inspection, material availability, permitting, discovery of concealed conditions, and other project factors.

Work is performed only under a separate written service agreement or contract signed by both parties. Where these Terms conflict with a signed service agreement, the signed service agreement controls with respect to that project.

Insurance Claim Coordination

Where you authorize us to do so, we may communicate with your insurance carrier or adjuster in connection with a claim. We are a restoration and construction contractor, not a public adjuster, insurance producer, or legal representative. Nothing on this Site or in our communications constitutes insurance advice or a representation about coverage, and decisions about coverage, scope, and payment rest with your insurer under your policy.

Intellectual Property

The Site and its contents — including text, graphics, logos, photographs, project imagery, layouts, and software — are owned by FCV Restoration & Construction or its licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, revocable, non-exclusive licence to view and download Site content for your personal, non-commercial use in evaluating our Services. All other rights are reserved.

Content You Submit

If you submit photographs, project descriptions, reviews, testimonials, or other content to us, you grant FCV Restoration & Construction a non-exclusive, royalty-free licence to use that content in connection with providing and documenting the Services.

Use of identifiable images of your property for marketing or portfolio purposes requires your consent, which you may withdraw at any time. See Section 5 of our Privacy Policy.

You represent that you have the right to share any content you submit, and that it does not infringe the rights of others.

Third-Party Links and Services

The Site may link to third-party websites and services, including review platforms, social media, mapping providers, and insurance carriers. We do not control and are not responsible for the content, policies, or practices of those third parties. Links are provided for convenience and do not imply endorsement.

Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, FCV Restoration & Construction disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete, current, or accurate.

This section applies to the Site only. Warranties relating to workmanship or materials on a specific project, if any, are set out in your signed service agreement.

Limitation of Liability

To the fullest extent permitted by law, FCV Restoration & Construction and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site.

Nothing in these Terms limits any liability that cannot lawfully be limited under applicable Illinois or federal law.

Indemnification

You agree to indemnify and hold harmless FCV Restoration & Construction and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Site, your violation of these Terms, or your violation of the rights of any third party.

Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Illinois, and you consent to the jurisdiction of those courts.

General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with our Privacy Policy and any signed service agreement, constitute the entire agreement between you and FCV Restoration & Construction regarding the Site.
